CLOUD Act

US law (18 U.S.C. § 2713) requires American companies to hand over data stored anywhere in the world on demand — including data held in EU data centres by Microsoft, Amazon or Google. No EU court order required. No GDPR protection applies.

NIS2 Directive

The EU's NIS2 cybersecurity directive (in force since October 2024) requires organisations to assess ICT supply chain risks. A US cloud provider's CLOUD Act exposure is a demonstrable and documented supply chain risk. Failure to assess it may mean non-compliance.

Schrems II

The Court of Justice of the EU has already invalidated one EU-US data transfer framework. The current Data Privacy Framework is under active legal challenge. Any arrangement depending on US legal compliance is fragile by design.
